Terms and Conditions

Welcome to Anna Bauman Photography LLC ("we," "us," or "our"). These Terms and Conditions govern your use of our website www.annabauman.com (the "Site"), booking of photography services, and purchase of digital products. By accessing our Site or engaging our services, you agree to be bound by these terms.

These terms are designed to comply with applicable federal laws, including the Federal Trade Commission Act, the Copyright Act, and consumer protection regulations, as well as Pennsylvania state law, including the Unfair Trade Practices and Consumer Protection Law.

Photography Services

Booking and Deposits

• A non-refundable retainer is required to secure your session date and time
• Your session is not confirmed until the retainer is received
• Retainers are applied toward your total session fee

Payment

• Full payment is due on or before the session date unless otherwise agreed in writing
• We accept major credit cards and other payment methods as indicated during booking
• All prices are in US dollars and subject to change without notice for future bookings

Cancellation and Rescheduling

• Client Cancellation: If you cancel your session, the retainer is non-refundable. Rescheduling requests made with at least 48 hours' notice will be accommodated when possible, subject to availability
• Photographer Cancellation: In the unlikely event we must cancel, you will receive a full refund of any payments made, or we will reschedule at a mutually convenient time
• No-Shows: Failure to appear for a scheduled session without prior notice will result in forfeiture of the retainer

Rescheduling Due to Weather or Illness

• Outdoor sessions may be rescheduled due to inclement weather at our discretion
• If you or immediate family members are ill, please notify us as soon as possible to reschedule
• We reserve the right to reschedule if the photographer is ill or unable to perform services

Image Delivery and Usage

Turnaround Time

• Edited images are typically delivered within the timeframe communicated at booking (usually 2-3 weeks for most sessions)
• Rush delivery may be available for an additional fee

Image Rights and Licensing

• Client License: Upon full payment, you receive a personal use license to print, share, and display your images for non-commercial purposes. This license is non-transferable and does not include the right to sell, license, or commercially exploit the images.
• Commercial Use: Use of images for business, advertising, or promotional purposes requires a separate commercial license agreement and additional fees
• Photographer Rights: In accordance with the U.S. Copyright Act (17 U.S.C.), we retain full copyright ownership of all images. We may use images for portfolio, marketing, social media, print, and promotional purposes unless otherwise agreed in writing prior to your session

Model Release

• By booking a session, you grant permission for us to photograph you and any individuals you bring to the session
• You further grant us a non-exclusive, royalty-free license to use the resulting images for portfolio, marketing, advertising, and promotional purposes
• Opt-Out: If you wish to opt out of portfolio or marketing use of your images, you must notify us in writing before your session. An opt-out fee may apply.

Image Editing

• We edit images according to our artistic style and professional judgment
• We do not provide unedited RAW files
• Requests for specific edits beyond our standard processing may incur additional fees
• We reserve the right to decline editing requests that conflict with our artistic standards

Image Storage and Delivery

• Final images are stored and available for download for a limited time (typically 90 days) as communicated at delivery
• We recommend downloading and backing up your images promptly
• Re-delivery of images after the download period may incur a retrieval fee
• We are not responsible for images not downloaded within the specified timeframe

Sessions Involving Minors

Parental Consent

• For sessions involving minors under 18, the booking must be made by a parent or legal guardian
• The parent or legal guardian represents that they have authority to consent to the photography session and the use of images as described in these terms
• For sessions involving children under 13, we do not collect personal information directly from the child; all information is collected from the parent or guardian

COPPA Compliance

We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information online from children under 13 without verifiable parental consent.

Client Responsibilities

Session Preparation

• Arrive on time and prepared for your session
• Communicate any specific needs, locations, or concerns in advance
• Ensure all participants have agreed to be photographed and that you have authority to consent on their behalf

Conduct

• You are responsible for the behavior of minors and guests during sessions
• We reserve the right to end a session early if conduct becomes unsafe, disruptive, or inappropriate, without refund of the session fee

Location Permissions

If you request a session at a private location or venue that requires permission, you are responsible for obtaining that permission prior to the session.

Digital Products

Purchases

• All digital product sales (ebooks, guides, presets, etc.) are final
• No refunds will be issued for digital products once delivered or download access is provided
• This is consistent with standard industry practice for digital goods and is disclosed at the time of purchase

Usage Rights

• Digital products are for your personal, non-commercial use only
• You may not redistribute, resell, share, or sublicense digital products without written permission
• Unauthorized distribution constitutes copyright infringement and may result in legal action

Limitation of Liability

Service Limitations

• Photography is an artistic service. While we strive to deliver high-quality images, we do not guarantee specific results, poses, or expressions.
• We are not liable for delivery delays caused by circumstances beyond our control, including but not limited to equipment failure, illness, natural disasters, or other unforeseen events

Image Loss

• While we take precautions to protect your images (including backup storage), we are not liable for loss or damage to images due to equipment failure, theft, file corruption, or other circumstances beyond our control
• Our liability in such cases is limited to a refund of fees paid for the affected session

Maximum Liability

• In no event shall our total liability exceed the amount you paid for the services or products in question
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

Indemnification

You agree to indemnify and hold harmless Anna Bauman Photography LLC, its owner, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of our Site, services, or products
• Your violation of these Terms
• Your violation of any third-party rights
• Any misrepresentation you make regarding your authority to consent on behalf of session participants

Intellectual Property

All content on our Site -including text, images, graphics, logos, and design -is owned by Anna Bauman Photography LLC and protected by U.S. copyright and intellectual property laws. You may not reproduce, distribute, modify, or use our content without written permission.

Dispute Resolution

Informal Resolution

Before initiating any formal legal action, you agree to contact us first and attempt to resolve any dispute informally for at least 30 days.

Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

Jurisdiction

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Pennsylvania. You consent to personal jurisdiction in these courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Consumer Protection

Nothing in these Terms is intended to limit your rights under the Pennsylvania Unfair Trade Practices and Consumer Protection Law or other applicable consumer protection laws. We are committed to fair and transparent business practices.

Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Site or services after changes constitutes acceptance of the updated terms. Material changes will be communicated via email to existing clients.
